Send the company directors to jail

The manner and the speed in which the Housebuyers Claims Tribunal is working only goes to show that government agencies can provide efficient service if they want to. Just look at the figures- 16,185 of the 18,700 cases registered since Dec 1, 2002 have been heard and disposed of.

An excellent record, taking into account the paper work involved and getting the parties together. However, the problem it seems, is enforcing the decisions of the tribunal. Some developers are using the system to delay payments to housebuyers who had been ordered by the tribunal to do so.

While it is heartening to note that the ceiling for claims will be be increased to RM50,000, at the same time, there should be some form of deterrent so that developers don't delay making payments.

While the law allows for errant developers to be prosecuted, on most occasions, middle-level managers appear in court to represent their employers. Most of the time, it's a slap on the wrist- a plea of guilt, a pitiful mitigation and a paltry fine. The directors who are responsible for causing the hardship are not there to face the music.

If there is a provision for mandatory jail sentences for directors of the companies, housebuyers will not be left in the lurch and payments would be made promptly.

We are now seeing a semblance of law and order and victims of unscrupulous developers can now seek justice- fast and cheap. Wouldn't the whole system be complete if directors are made accountable for failure to obey the ruling of the tribunal?
