Long wait for strata titles

I AM one of the 456 owners living
in the Heritage Condominium in Jalan Pahang. The developer, Safety
Development Corporation Sdn Bhd, went into liquidation in November 2003 and
the official assignee took over the management of the condominium until
February when the High Court appointed HLB Ler Lum to be the official
liquidator.
When the developer went into
liquidation, it had already applied for the strata titles, though it was
late in doing so. We should have obtained our titles within a short period
after the completion of the units and the issuance of the certificate of
fitness.
As the titles were yet to be
processed by the Land Office, we collected the necessary amount and paid
through the official assignee to obtain our strata titles in February.
When the titles were released by
the Land Office, the official assignee was unable to release the individual
titles to the owners as the High Court had appointed a liquidator who would
assume the responsibility of issuing the titles to the owners.
We have waited 12 years for the
titles and when we got wind that they were in the hands of the liquidator,
we assumed that it would act promptly in discharging its duties.
Unfortunately, things have gone from bad to worse.
Though we have submitted the
relevant documents to the liquidator, together with proof of payments for
the purchase as well as the maintenance, the liquidator is still withholding
our titles.
We are informed that the
liquidator wants to check whether we are the original purchase, if we have
the letter of vacant possession, if we have made maintenance payments, quit
rents, etc. How long will this take is anybody's guess. We may have to
endure a further delay of several years as their is only one person in the
liquidator's office checking 456 strata titles.
Our livelihood is at stake as we
need the titles in our dealings concerning bank loans and for the sale of
the property. The value of the units has gone down by about 35 per cent due
to the rundown stated of the buildings and poor management. It is our
fervent hope that Ler Lum will release the titles soon.
