PENANG: The owners of eight shops in Prangin Mall who are suing the complex
developer and management are busybodies and mischief makers, a High Court
here was told.
“They are suing the complex developer and management for their own personal
satisfaction and not for the benefit of all the other parcel owners,” added
lawyer V. Jeevaretnam.
Jeevaretnam is representing the defendants – Getaran Unggul Sdn Bhd, Prangin
Mall Sdn Bhd and Istimewa Sejati Sdn Bhd.
Jeevaretnam was making submissions yesterday at the hearing of an
application by his clients to strike out the plaintiffs' claim.
The eight plaintiffs are suing the defendants for failing to apply for
strata title, mis- management of the com- plex by allowing “temporary''
stalls to be set up and collection of rentals from the stalls without
approval of the local authorities.
The eight plaintiffs are Ng Cheng Oo, Lai Saw Looi, Ch'ng Hun Pin, Wu Mei
Eng, Ch'ng Giap Theng Sdn Bhd, Heng Ah Leak, Loh Siam Kiang and Ch'ng Hun
Boon.
Lee Khai, counsel for the plaintiffs, submitted that the relief sought by
the plain- tiffs showed that the suit was for the benefit of all shop lot
owners and not for their personal gain.
Submissions before Judicial Commissioner John Louis O'Hara will continue on
