Three sue over condo security

KUALA LUMPUR: Three tenants of the Bukit Pandan Condo 2 in Pandan Perdana
have filed two separate suits against the developer and management of the
condominium for alleged negligence.
Retiree Lee Chee Chen, 55, his daughter Patricia Lee Pei Chin, 25, and Chua
Monk Lin, 59, named Cape Glory Sdn Bhd and Brisdale Resources Sdn Bhd as
first and second defendants, respectively, in their suits filed yesterday by
lawyer Keppy Wong Khai Pun in a Sessions court here.
In the first suit, Chee Chen and his daughter Patricia claimed that his
Perodua Kembara that was parked at the condominium on June 6 had gone
missing the next day.
They also claimed that a new Hyundai Atos bought by Patricia on June 13 was
also broken into a month later and the car's compact disc player was stolen.
They said they no longer felt safe, even in their own home and were worried
that their car might go missing again because there was nowhere else to
park.
They are seeking RM56,300 in special damages plus general damages, including
aggravated and exemplary damages, interest, costs and other relief.
In the second suit, Chua claimed that her unit was broken into while she was
working in the day, as a result of which she lost RM3,000, A$400 and RM5,000
worth of jewellery.
She also claimed that her property was damaged.
She is seeking RM10,460 and A$400 in special damages plus general damages,
including aggravated and exemplary damages, interest, costs and other
relief.
In both suits, the plaintiffs, among other things, claimed that the
defendants, who collected maintenance fees from the condominium's residents
every month, had failed to ensure the safety of the condominium's compound
and failed to ensure that only cars belonging to tenants were allowed in.
The plaintiffs also claimed that the defendants allowed non-tenants to go in
and out of the condominium without any form of monitoring and that they had
failed to take security precautions at strategic locations. |
