'Take park developer to court'

SUBANG JAYA: Residents here have been advised to take legal action against
Subang Ria park developer if they feel they have been cheated by the
latter.This advice came from Kelana Jaya MP Loh
Seng Kok after a meeting with some 30 residents at Sri Kuala Lumpur school
in SS15 here last night.
The meeting was held to discuss measures to preserve the
park. The residents have been protesting against the move by a
developer to turn a portion of the 30-hectare park in SS15 into a theme
park, comprising a paint ball field, a go-kart circuit, a fishing lake, a
futsal centre and a restaurant.
They claimed they were cheated by the developer who had
marked Subang Ria as recreational park in the brochure when they purchased
their houses.
They are also appealing for the park to be gazetted as a
green lung, failing which residents fear they would soon have to pay to be
able to enjoy the fresh air and beauty.
Loh, accompanied by a lawyer Derek J. Fernandez, said
residents should look into legal remedy if they feel cheated by the
developer.
On the residents' request for the park to be gazetted as
a green lung, he said the matter lies in the hands of the Selangor
Government.
He said that in principle, residents should not be
denied their right for an open space or recreational park promised to them
by the developer.
Fernandez, meanwhile, said residents should get legal
advice to determine their right to the park. "If, it is a fact that the park has been promised as a
public recreational park, then they have the right to demand that the land
be preserved as one," he said.
He added the residents must ascertain as to how a title
could be issued for the land if it is a public recreational park.
Residents' representative, Ching Eng Keat, 67, said he
would arrange a special meeting with residents to discuss Loh's advice.
During the meeting, residents agreed to form a pro-tem
residents' association to lobby for the park to be gazetted as a green
lung by the State Government. Council. |
