Semporna housing developer ordered to repair two units
29/01/2005 Daily Express

Tawau: A housing developer in Semporna has been ordered by the Consumer Claims Tribunal to carry out the necessary repairs on two houses there.

Heng Loong Trading Sdn Bhd must also cut down the coconut trees that have been causing safety concerns to the occupants of the two houses located in Taman Mansiu, Semporna, after getting consent from the owner of the coconut farm.

The house owners, Mohd Gazali Mohd Yunus and Ambrus Hj Mohd Ali, in their claims, said it was not even one year after their moving in that cracks started appearing and damaging the walls, while the roofs were leaking, rendering their residences unsafe.

They claimed the building material were of poor quality while the foundation of the houses were not solid. They said they were also at the mercy of falling coconuts from the coconut farm nearby.

During the hearing, the house owners also told the tribunal that this was the second time they were bringing the matter to the developer's attention. In the first case, they said, even the police were involved, and the developer had initially obliged in doing the repairs.

However, the work was done only halfway and the house owners were forced to employ workers to finish the job. They said they were compensated only with RM900 and RM2,000, respectively.

According to them, when they reported to the developer on recurring damages, the latter refused to acknowledge them.
