withdraws application

Kuala Lumpur, Wed. - Housing Developer Fadason
Holdings Sdn Bhd, which challenged the awards given by the Tribunal
for Homebuyer Claims to 42 house buyers, withdrew its application
for a judicial review in the High Court here today.
No reasons was given by its counsel, Sean Yeow,
who informed judicial commissioner Wan Afrah Wan Ibrahim that his
client wished to withdraw its application.
Fadason had sought a judicial review of an award
granted on two issues by the tribunal in February.
The first was on the calculation of liquidated
ascertained damages (LAD) claims by the house buyers for late
delivery, which the tribunal worked out from the date the purchaser
paid the deposit, and not from the date the sale and purchase
agreement (SPA) was signed.
The second issued on on the locus standi of the
claimants. |
