Yong: Two
policies to protect condo owners

Kota Kinabalu: The Local Government and Housing
Ministry applies two different policies to protect condominium and
apartment owners from errant management bodies appointed by housing
developers, the State Legislative Assembly was told Wednesday.
Its Assistant Minister, Edward Yong, said the first policy is meant
for apartments that have already obtained the occupation
certificate, while the second is for those that are just applying
for a housing developer’s licence.
“Under the first policy, the Ministry has included a condition in
the renewal of a housing developer’s licence, that is a developer
must submit an audited annual account statement of their management
body to the buyers.
“The management body is also required to produce its quarter-year
account statements to the buyers and housing controller every
quarter of the year,” he added.
Under the second policy, Yong said the Ministry would ensure the
Sale and Purchase Agreement contains clauses that it is compulsory
for a housing developer to produce a quarter-year account statement
of their appointed management body to the owners and housing
controller in each quarter of the year.
“The housing developer is also required to produce their management
body’s audited annual report to the buyers and housing controller,
besides having supply an administration office space for the
management body and to allow the apartment buyers’ committee to
handle a problem and give their views to the management body.”
These actions were taken to ensure housing developers were
transparent and systematic in the use of the management fee, said
Yong in reply to Likas Assemblyman Liew Teck Chan.
