19 cases at first tribunal

THE Homebuyer Claims Tribunal was held for the
first time outside Kuala Lumpur with hearings conducted in Penang
and Johor.
Nineteen cases were heard in Penang yesterday involving housing
projects in Penang and Kedah.
Tribunal secretary Wan Hussin Wan Hassan said the hearings would be
conducted at different states depending on the majority of cases
received.
“This is done to accommodate claimants in line with the tribunal's
motto of Mudah, Murah dan Cepat (Easy, Cheap and Fast),” he told
newsmen at the first hearing in Penang yesterday at Bangunan Tuanku
Syed Putra at Downing Street.
He said the tribunal had no permanent office outside Kuala Lumpur
and the dates and venue of the hearings were under the jurisdiction
of the tribunal chairman.
The tribunal which has eight appointed members taking turns to
preside over the hearings, is chaired by Kamardin Hashim while the
deputy is Haini Hassan.
Wan Hussin said claims for late delivery of vacant possession formed
the bulk of the 7,477 registered cases involving housing projects in
the country (except Sabah and Sarawak) since the tribunal's
inception on Dec 1 2002 until Aug 10 this year.
He said other claims involved technical issues such as building
defects or failure to meet specifications as stated in the Sale and
Purchase (S&P) agreement, adding the tribunal would not hear cases
involving abandoned projects.
More than half of the 7,477 cases involved projects in Selangor
(5,408) followed by the Federal Territory (783), Negri Sembilan
(335), Kedah (186), Johor (167), Penang (154), Kelantan (109), Perak
(85), Pahang (70), Perlis (5) and Terengganu (5).
He added that 4,947 of the cases had been settled up to Aug 10.
At the hearing yesterday in Penang presided by Zamani Ibrahim,
buyers Ang Yam Ping and Lai Sow Yew were awarded over RM14,700 for
late delivery in the absence of a representative from Antasia
Holdings Sdn Bhd.
In several other cases involving Uda Land (Peruda) Sdn Bhd, the
claimants were awarded between RM2,400 and RM5,400.
For a registration fee of RM10, homebuyers can file for claims of
