18 buyers sue
developer over late delivery of houses

IPOH, Fri. - Eighteen housebuyers are suing a developer, seeking the
completion of their homes in Taman Perpaduan Permai here and more
than RM500,000 in compensation for late delivery.
Their individual suits against Trinity Home Builders
Sdn Bhd were filed at the High Court by their lawyer Nga Kor Ming.
The 18 signed their Sales and Purchase (S&P)
agreements with the developer between Nov 24, 1997 and April 23,
2001. The houses were sold to them for between RM122,443.60 and
RM180,888.
In their statements of claim, the plaintiffs said

agreed to build and hand over two-and-a-half-storey terrace houses
of the first phase of Taman Perpaduan Permai within 24 months of
signing the S&P agreement.
According to the agreement, the company was also
to pay damages for late delivery at 10 per cent per annum based on
the purchase price, beginning from the date it was to have handed
over vacant possession of the house.
The plaintiffs are also claiming for costs and
eight per cent interest
on the money owed them for late delivery.
Alternatively, they are seeking a court order to
allow them to appoint a contractor to complete building the houses,
with Trinity Home Builders having to bear the costs.
"We will try to consolidate the lawsuits later,"
