Bid to make tribunal function more
effectively

Government is studying various ways to
incorporate the "retrospective effect"
in the housing tribunal to enable it to
function more effectively, said Minister
in the Prime Minister's Department Datuk
Seri Dr Rais Yatim.
"It is too easy for
many quarters to blame the Act
originators such as the Attorney-General
and drafters of the law over a recent
furore pertaining to the housing
tribunal.
"But one must
understand that the interpretation of
the law can go one way or the other in
court," he said here yesterday.
Early this month,
Justice Datuk Md Raus Sharif allowed an
application by Puncakdana Sdn Bhd and
Westcourt Corp Sdn Bhd to seek judicial
review against the awards given by the
tribunal in favour of six house buyers
who claimed damages for late delivery of
their houses and failure to complete the
common facilities.
The Attorney-General
had since filed a notice of appeal
against the decision declaring that the
housing tribunal did not have
jurisdiction to abjudicate disputes over
property bought before Dec 1, last year. |
