House buyers claim for late delivery

ABOUT 250 buyers of newly-completed medium-cost apartments in Taman
Fadason in Jinjang Utara gathered yesterday for an insight into the
procedures ao making claims for late delivery of their units with
the Housing Tribunal.
With the help of an adhoc committee and its adviser, MCA Kepong
public service and government affairs bureau chairman Yee Poh Ping,
the buyers at the MCA Jinjang branch office were informed that the
developer, Fadason Holdings Sdn Bhd offered them compensation,
following the submission of a compensation form, 'Borang Satu' on
March 29.
"The offer by the developer was compensation calculated from the
date they signed the sale-and-purchase agreement," said Yee.
"However, after a meeting with officers from the Housing Tribunal on
April 11, we learned that compensation should be made from the day
buyers paid the 10 per cent deposit."
Hence, Yee said, the buyers are not happy with the offer and will be
submitting another form, "Borang Tiga", to counter-claim the offer.
The offer was made following the first submission of claim, and it
was reported in The Malay Mail on Mac 24, that some 150 buyers
gathered the previous day to submit "Borang Satu" to the Housing and
Local Government Ministry concerning the late delivery.
"After receiving the offer, each buyer will have to get back their
initial forms and wait until they receive a "Borang Dua" from the
developer, then fill another form for the counter-claim," said Yee.
Yee said he hoped that all those who have received the forms from
the developer will come to the ad-hoc committee if they have any
query on how to fill out the form or if they have need more
information.
The committee hopes to submit the counter-claim forms in two weeks.
It has scheduled meetings on Wednesday and April 30, from 8pm to
10pm, to help buyers fill out the necessary documents.
