Condo buyers
seek compensation for late delivery

About 150 residents of the newly-completed medium-cost condominium units at
Taman Fadason, Jinjang Utara, gathered recently to take action against the developer
for late delivery of their units.
With the assistance of the Housing, Tribunal, purchasers from blocks D, E and
F, led by MCA Kepong Public Service and government Affairs bureau chairman Yee
Poh Ping, filed their claims, which will be submitted to the Housing Tribunal,
which is under the Housing and Local Government Ministry.
Yee, who also acts as adviser to the Buyers Ad-hoc Action Committee, said there
were 720 units in the there blocks, currently 20 per cent occupied.
"The developers, Fadason Holdings Sdn. Bhd, started this project in June 1999
but did not complete it within the stipulated three-year period" Yee said.
He said bank loan interest of the purchasers were currently riding high and
they are seeking compensation for late delivery.
"The apartments were bought for RM60,000 a unit and purchasers are entitled
to claim the bank loan interest incurred so far, due to late delivery," he said,
adding that the tribunal entertained claims below RM 25,000.
"We have received claims ranging from RM1,000 to RM 5,000 and purchasers will
have to submit their claims with four other documents comprising the sale and
purchase agreement, mutual covenants agreement, receipt of three percent deposit
and letter of vacant possession from the developer," he said.Yee said buyers
should be aware that the Government would help all end-users and buyers of houses,
apartments and condominiums if they were delivered late by developers.
"We appeal to all buyers of blocks D, E and F to submit their claims together
with the supporting documents to the Kepong MCA service Centre by end of this
month to the tribunal."
