Low compensation for late delivery

MALA is seeking more compensation from her developer for the late
delivery of her property. "I bought a condominium in Bandar Baru
Ampang in June 2000 but it was delivered more than a year late.
"To be specific, they were 391
days late and according to the Sales and Purchase agreement, late
delivery charges is to be incurred by the developer."
Mala has contacted the developer,
Talam Corporation, on numerous occasions. She was only offered a
compensation of RM5,000, when the actual late delivery amount is
RM17,000.
"This is unfair and by right they
should be also bearing the interest amount due to the late
delivery."

says their Liquid Ascertained Damages department has proposed to the
purchaser RM5,000 as stipulated, twice, but she refused.
"However, we welcome the purchaser
to come personally to renegotiate. But if she is still not
satisfied, we respect her right to pursue the case further. |
