30% offer for late delivery of property

RAJASEKARAN is seeking compensation amounting to RM1,500 from his developer for late delivery of his property.

He bought an apartment in Puchong six years ago but it was delivered 64 days late. "As per the sales and purchase agreement, the developer is subject to late delivery charges," he says.

"I wrote them a letter in 2001 and another in 2002. Their staff from the Liquid Ascertained Damages (LAD) department said that they were willing to compensate 30 per cent of the amount (RM1,500)," he adds.

When asked why they were not paying the full amount, they told him it was company policy. "They charged me when my financier remitted the last payment a day late.

Why don't they apply the same rules on themselves?" he says. * Talam Corporation customer service centre executive Bonnie See says that although their LAD department called Rajasekaran twice last year and once this year regarding the matter, he wasn't happy with the settlement.

"We offered him RM480 but he refused to accept it. I suggested that he call our LAD department to re-negotiate the amount. We respect his rights. Whether or not he wants to accept the amount is up to him,"
