Angry residents plan legal action

IPOH: Furious residents of Ipoh Garden East here plan to take the Ipoh City Council and a developer to court over factories which have been
constructed too near their homes.
The residents living along Lintasan Perajurit 17 said they felt cheated because the land opposite their homes, which they claimed was initially
meant for low-cost homes, was turned into a light industrial zone.
Action committee chairman Teo Sin Hock, 73, alleged the developer and the council had violated many agreements over the last few years without
giving consideration to their feelings.
After many complaints, the residents managed to get Mentri Besar Datuk Seri Mohamad Tajol Rosli Ghazali involved.
Tajol Rosli suggested that the nine factories be demolished and the 0.1ha site be left vacant or turned into a recreational park.
“But the developer submitted a proposal to the state in March to convert the factories into shoplots and not proceed with the recreational park
project,” he claimed.
Teo alleged the factories violated the Town Planning Act 1976 which
required a 19.8m buffer zone between housing and industrial sites.
On Aug 21, 2000, during a meeting between Datuk Bandar Datuk Talaat Husain, the developer, Land and Mines Department, and Town and Country
Planning Department, it was agreed that Lintasan Perajurit 17 not be used as the access road for the factories.
“Last Tuesday, the developer breached the agreement by demolishing part of a concrete wall along Lintasan Perajurit 17 to build a 6m gate to use
the road for access,” said Teo on Sunday.
Taman Canning assemblyman Datuk Hiew Yew Can, who has been
campaigning for the residents since 1996, said he supported their plan to take legal action.
“They are exercising their right to seek justice,” he said, and urged the developer to stick to the agreement and put an end to the long-standing
problem.
When questioned on what the council had done about the problem, Talaat said he could not comment without further investigation. |
