Eighteen apartment units of a stalled project in
Kurau Road, off Perak Road, are being tendered for auction without
the consent of the owners.
The 18 units of Suria Mutiara Apartments have appeared in the
Property Tender Nov/Dec 2000 brochure by Pengurusan Danaharta
Nasional Bhd with an asking price of RM1.7 million.
Sub-contractor Anthony Goh, who obtained an apartment unit from
project manager MBf Properties Servicing Sdn Bhd on contra for work
done on the project, said that his unit was among the 18 units
listed by Danaharta to be auctioned off by open tender.
"I have signed the Sales and Purchase agreement, so by right the
apartment is mine,'' said the committee member of the Suria Mutiara
Purchasers Pro-tem Committee at a press conference called by Penang
MCA Public Services and Complaints Department chairman Ooi Chuan
Aik.
The Suria Mutiara Apartment project was stalled when its developer,
Eastern Enterprise Bhd, was declared bankrupt for failing to settle
outstanding debts to its contracter on Nov 16 last year by the Johor
High Court.
The project, which was to be completed last year, is under
liquidation by court appointed liquidator Arthur Anderson & Co.
Pro-tem committee chairman of the purchasers Sulochana Veerasamy
said that as purchasers, they have a right to know the status of the
project.
She claimed that they have been given the run-around by the project
manager, the liquidator, and the finance company.
"Many of the purchasers are losing out by continuing to pay
interests for the loans we took out to buy the apartments. We don't
even know if the project would be revived?'' said Sulochana, whose
pro-tem committee represents 86 other purchasers of the 14-storey
apartment block.
A source in Danaharta said that the 18 apartments are being sold by
open tender because 'Danaharta is exercising is chargee right to
foreclose on its collateral.'
Danaharta bought over MBf Finance's non-performing loans last year
and the 18 apartment units were secured as collaterals.
The source added that Danaharta's dealing with the finance company
was strictly on its non-performing loans, and hence has no
background knowledge of the ownership of properties.
MBf Properties Services Sdn Bhd general manager Teoh Oo Seng refused
to comment saying that since the project is under liquidation, the
party responsible for the project's development is Arthur Anderson
and Co.
"We are no longer the project manager and it will not be appropriate
for us to comment,'' he said.
Efforts to contact Arthur Anderson & Co for comments have been
unsuccessful as the person in charge of the project liquidation is
outstation.
Ooi said that he would co-ordinate discussions between the
purchasers and Arthur Anderson. |
