Bylaw to ensure CF in two weeks

KUALA LUMPUR, Thurs. - The building bylaws will be amended
to ensure certificate of fitness will be issued to projects within two weeks
after submission of applications.
Housing and Local Government Deputy Minister Datuk Azmi Khalid said today
the Cabinet had recently agreed to amend the Unified Building Bylaw 1984 to
speed up the CF process.
The proposed amendments also require that all technical aspects be approved
by the various departments involved before the developer applies for the CF.
"The amendment's main objective is to ensure developers are more responsible
for their projects as current laws seem to 'favour' them.
However, the National Council for Local Government whose members comprise
Menteris Besar and Chief Ministers, have agree to the amendments before they
are implemented.
"The meeting will be held in June and once the council agrees, the bylaw will
be implemented at all levels," Azmi said, adding that the Attorney-General
had already agreed to the changes. At present, developers can apply for CF
before technical aspects of their project are approved and receive approval
by the various departments after CF application.
They also hand over the keys to buyers before CF approval.
"This practice puts buyers at the mercy from the time they receive their keys
to ask developers to rectify any problems with the premises such as leaking
pipes, cracks on the wall and so on."
Under the Hire and Purchase Act, developers have 24 months to deliver houses
to respective buyers and 36 months for multi-tiered and flats.
"The amendments will make CF applications stricter and fairer towards buyers,"
Azmi said, adding that the Ministry was currently working out the final details
of the proposed amendments.
