Strata titles: Errant developers
to face action

Seremban, Tues - The State Government has
directed the Land and Mines Department to initiate court action against developers
who continue to ignore repeated reminders to apply for strata titles of completed
multi-storey buildings.

Samad said today the State was disappointed with the attitude of the developers
for ignoring its earlier reminders.
Speaking after chairing the State Land and
Mines Action Committee meeting at Wisma Negeri, he said most of the developers
were responsible for projects in Port Dickson and here.
"The department has to date initiated court
action against four developers and the cases are pending," he said.
Mohamad Isa said the department had estimated
that some 40 developers had yet to submit applications for strata titles.
He said the State was studying the possibility
of getting developers of future multi-storey projects to set aside survey
fees to carry out the processing of strata titles without any hitch.
"There is tendency among the developers
to assume that their job is done once they have obtained the certificate of
fitness but such notions are incorrect as they are bound by the law to apply
for the strata titles," he said.
He also urged buyers of apartments or multi-storey
buildings to insist that developers hand over the strata titles and CFs to
them when making a purchase.
"House buyers should also insist that their
developers apply for the strata titles, instead of only asking for the CFs.
"They must realise that the titles are important
documents which are required when they mortgage or sell properties."
Mohamad Isa said the department had so far
approved strata title applications by two developers. Another five applications
are being processed.
He said six applications were being scrutinised
by the Survey Department.
