Second time unlucky for housebuyer
11/07/2002 The StarFor 34-year-old purchasing officer Cheah Hock Lye, it is a case of
second time unlucky in his attempt to own a house.
After his failed investment in the stalled Taman Terubong Indah
(Majestic Heights) Phase One, Cheah invested in an apartment unit at
Mutiara Indah, Jalan Yeap Chor Ee, last year.
Little did he know the second investment would turn into another
nightmare for him.
Last August, he signed a sale and purchase (S & P) agreement with the
38-year old apartment owner and paid a RM10,700 down payment.
After the three-month period was up, Cheah said the seller failed to
hand over the apartment keys to him.
I managed to contact him and asked for the keys but he evaded my
request. In April, he issued me with three post-dated cheques for RM7,500.
He also promised to settle the balance later, Cheah told a press
conference arranged by the state MCA Public Complaints and Services Bureau
yesterday.
He said all the cheques bounced and a check with the issuing bank
revealed that the account had been closed.
To make matters worse, Cheah said attempts to reach the seller via his
handphone also failed and he could not be traced.
A report had been lodged with the state police contingent headquarters
on Monday.
Cheah added that even his lawyer refused to proceed with the case
saying that the matter was beyond our control.
Bureau chief Ooi Chuan Aik urged the seller to present himself in 14
days to settle the issue or legal action would be instituted.
I will also write to Bank Negara and the Malaysian Bar Council to seek
their assistance, he said.
Ooi said this was the first such case reported to his bureau.
State MCA legal bureau chairman Lim Boo Chang, who was present, said
under the S & P agreement, Cheah could exercise the option of forcing the
vendor to sell the property to him.
