Highrise buyers go to the police
13/01/2000 The StarAbout 870 buyers of the controversial Majestic Heights Phase One
project lodged a police report yesterday against the developer for
allegedly violating the sale and purchase agreement.
The Ad-Hoc Committee for Taman Terubong Indah (Majestic Heights) Phase
One Purchasers, representing 56% or 870 of the 1,557 buyers, also lodged
similar reports against the architect, banks and financial institutions at
the state police headquarters.
"We have no more confidence in the developer which keeps making empty
promises," said committee adviser S. L. Chang.
He said the buyers wanted police to investigate, among others, the
authenticity of a completed application form (Borang E) for a
Certificate of Fitness (CF) signed by the architect.
"Another letter from the council last month stated that any completed
Borang E should be accompanied by a checklist and approval letters
from all technical departments. But the architect only submitted the
Borang E," he said.
Chang also claimed the developer handed over vacant possession of the
units to the buyers in 1998 when the units were not fully completed. "Till
today, most of the units are still not ready," he said.
Committee chairman Lim Beng Hong said a letter dated Dec 23, 1999, by
the Board of Architects Malaysia stated that the architect had failed to
provide a copy of "Certificate of Practical Completion" because repair
works to the units had yet to be completed.
The board also sent two letters to the Housing and Local Government
Ministry, and Penang Municipal Council to inform that the board had set up
a committee to investigate the matter.
On July 26 last year, the committee filed a notice through their
lawyers to oppose the winding-up petition filed by creditors of Majestic
Heights. The case is still pending.
